Terms of Service

These Terms of Service ("Terms") form an agreement between you and ShowCase Cards LLC ("ShowCase", "we", "us" or "our"). They apply to our website at showcasehq.io, the web application at app.showcasehq.io, our iOS and Android applications when released, and all features within them (collectively, the "Services").

By accessing or using the Services, you confirm that you have read these Terms and agree to be bound by them. If you do not agree, do not use the Services. If you are entering into these Terms on behalf of a business, you confirm that you have authority to bind it.

Our Privacy Policy forms part of this agreement and describes how we handle your information.

The Services

ShowCase provides pricing information for collectible cards, tools for cataloging a collection, and tools for dealers to record purchases, sales and trades. We record the information you enter and we produce estimates of card values. We do not buy or sell cards, hold funds, ship goods, or participate in transactions between users.

Your account

An account is required for most features. You must provide accurate information when you register and keep it current. You are responsible for all activity that occurs under your account, must keep your credentials confidential, and should notify us at [email protected] if you believe your account has been accessed without your authorization.

You may hold one account. You may not create an account for another person without their permission, and you may not sell, rent or transfer your account to anyone.

You may delete your account at any time from Settings. The effects of deletion, and what is retained, are described in our Privacy Policy.

Eligibility

You must be at least 13 years old to use the Services. If you are under 18, a parent or guardian must agree to these Terms on your behalf. Where the law of your jurisdiction sets a higher minimum age for entering into an agreement of this kind, that age applies.

You may not use the Services if we have previously closed your account for breach of these Terms, or if applicable law prohibits you from doing so.

Paid plans

• Plans and pricing. ShowCase Pro is $5 per month and Vendor Pro is $20 per month. The features included in each plan are listed on our pricing page. The free plan remains free.
• Billing. Payment is processed by Stripe. Your payment card details are provided to Stripe and are not received by us. By subscribing, you authorize us to charge your selected payment method at the interval you choose.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period until cancelled. You authorize this recurring charge when you subscribe.
• Cancellation. You may cancel at any time from Settings. Cancellation prevents the next charge and your paid plan continues until the end of the period already paid for. Deleting your account cancels your subscription on the same basis.
• Refunds. We do not refund the unused portion of a billing period. Where applicable law grants you a right to a refund, that law prevails over this provision.
• Price changes. We may change the price of a plan. We will give you at least 30 days' notice before a change takes effect, and you may cancel before it does.
• Failed payments. If a charge is declined, we may retry it and may suspend paid features until payment is received.

Pricing information

The ShowCase Market Price is an estimate. It is derived from TCGplayer data and recorded sold comps, and we display the confidence score and value range behind it so that you can assess how much weight to give it.

It does not constitute an appraisal, a guarantee, an offer to buy or sell, or financial advice. Card values fluctuate, our sources may be inaccurate or out of date, and grading and condition assessments involve judgment. Decisions about what to pay for a card, what to accept for it, and whether to treat a collection as an investment are yours alone and are made at your own risk. You should obtain professional advice before making a significant decision.

The scanner

The scanner uses your device camera to photograph a card and identify it. You grant camera access when you first use it, and you may withdraw that access in your device settings at any time.

The scanner will sometimes identify a card incorrectly. Poor lighting, motion blur, an unfamiliar card, or a printing closely resembling another can each produce an incorrect result. You should verify the result before relying on it, particularly before pricing a transaction. Our handling of scanned images is described in our Privacy Policy.

You may only scan cards in your possession. You may not use the scanner to reproduce or distribute artwork you do not have the right to reproduce or distribute.

Transactions between users

ShowCase records transactions. It is not a party to them.

Where a dealer purchases cards from you, where you sell from your inventory, where two users trade, or where a QR code directs a buyer to a payment application, the transaction takes place between the parties involved. We do not hold funds, verify the identity of any user, guarantee that a card is authentic or graded as represented, or intervene in disputes. Any dispute arising from a transaction is between you and the other party.

Payment handles you save are used to generate a payment link at the time of sale. You should verify the destination of any payment before sending it.

Content you publish

Certain information you enter may be published, including a collection you mark public, your profile, and a vendor storefront with its business name and description. You retain ownership of the content you publish. Content you publish is accessible to anyone with the link.

By publishing content, you grant us permission to host, store, display and distribute it as necessary to operate the Services, for as long as you keep it published. That permission ends when you unpublish the content or delete your account. We claim no ownership of your content and will not use it for any purpose other than operating and promoting the Services.

You are responsible for the content you publish and confirm that you have the right to publish it. Content must relate to collectible cards and must not be unlawful, misleading, hateful, harassing, sexually explicit, violent, or directed at another individual. It must not impersonate any person or entity, and must not disclose another person's private information. We may remove content that breaches this section, and we are under no obligation to review content before it is published.

Acceptable use

You may not:

• use the Services to violate any law, or to assist another person in doing so;
• scrape, crawl or bulk-download the catalog, pricing data or any user's pages;
• resell, sublicense or rebrand access to the Services;
• reverse engineer, decompile or disassemble the Services;
• circumvent rate limits, plan limits or paywalls, or create accounts by automated means;
• disrupt, overload or interfere with the Services, or probe them for security vulnerabilities;
• upload malicious code;
• use the Services in a manner that imposes a burden on our infrastructure disproportionate to ordinary individual use.

We may impose reasonable usage limits, including on scanning and pricing lookups, to maintain availability for all users. We will provide notice where practicable.

Our intellectual property

The Services, and the software, design, text, layout and data underlying them, are owned by ShowCase and its licensors and are protected by copyright, trademark and other laws. These Terms grant you permission to use the Services and nothing further. You may not copy our materials, remove proprietary notices, or use any part of the Services for commercial purposes without our written permission.

We use aggregated and de-identified data regarding use of the Services to operate and improve them and to develop new features. That data does not identify you.

No affiliation with rights holders

ShowCase is an independent tool for collectors and dealers. We are not affiliated with, endorsed by, or sponsored by The Pokémon Company International, Nintendo, Creatures, GAME FREAK, Wizards of the Coast, Konami, TCGplayer, PSA, Beckett, CGC, or any other publisher, marketplace or grading company. Card names, set names, images and trademarks are the property of their respective owners and appear here to identify the cards they describe.

Third-party links and affiliate links

Certain pages link to card listings on third-party sites. Some of those are affiliate links, which means we may receive a commission if you make a purchase after following one. This does not increase the price you pay and does not affect the prices we display or how we rank results.

We do not control third-party sites and are not responsible for their content, their pricing, or their handling of your information.

Suspension and termination

We may suspend or close your account, or withdraw any part of the Services, if you breach these Terms, if we are required to do so, or if continuing to provide them would create a risk to other users or to us. We will give advance notice where we are able to. Where the matter is urgent, we will notify you as soon as practicable afterwards.

We may also modify or discontinue features. If we discontinue a paid feature you are subscribed to, we will provide a pro rata refund for the portion you have paid for and cannot use.

Disclaimer of warranties

The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free or secure, that pricing or card data will be accurate or current, that the scanner will identify a card correctly, or that the Services will meet your requirements. Some jurisdictions do not permit these exclusions, in which case they do not apply to you.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, loss of revenue, loss of data, or losses arising from a transaction you entered into, a price you relied on, or a card the scanner identified incorrectly.

Our total aggregate liability for any claim relating to the Services is limited to the greater of one hundred United States dollars and the amount you paid us in the twelve months preceding the event giving rise to the claim.

Some jurisdictions do not permit these limitations, in which case our liability is limited to the fullest extent permitted there. Nothing in these Terms limits liability that cannot lawfully be limited.

Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless ShowCase and its officers, employees and contractors against any claims, damages, losses and reasonable legal costs arising from your use of the Services, content you publish, a transaction you entered into with another user, or your breach of these Terms or of any third party's rights.

Applications obtained from the App Store or Google Play

Where you obtained our application from Apple or Google, the following applies. This agreement is between you and us, and neither Apple nor Google is a party to it. Neither is responsible for the application, its content, its maintenance or support, or any claim you may have relating to it, including product liability claims, any failure to conform to a legal requirement, or any intellectual property claim. If the application fails to conform to any applicable warranty, Apple will refund the purchase price and will have no further obligation. You represent that you are not located in a country subject to a United States embargo and are not listed on any United States prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

General

• Governing law and jurisdiction. These Terms are governed by the laws of New Mexico, without regard to its conflict of law rules. The state and federal courts located there have exclusive jurisdiction over any dispute arising from these Terms, and each party consents to that jurisdiction.
• Consumer protection law. Where mandatory consumer protection law in your jurisdiction conflicts with any provision of these Terms, that law applies.
• Entire agreement. These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Services.
• Severability. If any provision is held unenforceable, the remaining provisions remain in force.
• No waiver. A failure to enforce any provision does not waive our right to enforce it later.
• Assignment. You may not assign your rights under these Terms. We may assign ours to an affiliate or in connection with a merger, acquisition or sale of our business.
• Notices. We may give notice to you at the email address associated with your account or by posting within the Services. Notices to us should be sent to the address below.
• Survival. The sections covering content you publish, our intellectual property, disclaimer of warranties, limitation of liability, indemnity and governing law survive termination of your account.

Changes to these Terms

We may update these Terms as the Services change. The date at the top of this page indicates when they were last revised. For a material change we will give at least 30 days' notice, and you will be asked to accept the revised version the next time you use the Services. Continued use after that date constitutes acceptance.
